Terms of Use
Last updated: October 31, 2026
These Terms of Use ("Terms") are an agreement between you and Pearson Smith ("we," "us," or "our"), the developer of the License to Sail app (the "App") and the website https://www.licensetosail.app (the "Site").
1. Acceptance
By downloading, accessing, or using the App or the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial study on Apple-branded devices that you own or control, as allowed by the Apple Media Services Terms and Conditions (the "Usage Rules"). You may not copy, resell, rent, lease, sublicense, modify, reverse engineer, or create derivative works from the App, except where the law expressly allows it.
3. Purchases, subscriptions, and free trials
All payments are processed by Apple through your Apple ID. Apple's terms govern billing.
- Monthly subscription: $9.99 per month. Annual subscription: $39.99 per year. Prices may vary by country and may change. We will give notice as Apple requires.
- Free trial: Each subscription includes a 1-week free trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and your Apple ID will be charged. Cancelling during the trial is your responsibility.
- Auto-renewal: Subscriptions renew automatically at the same price and length unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling: Go to your Apple ID settings (Settings > [your name] > Subscriptions). After you cancel, you keep access until the end of the current paid period.
- What a subscription includes: All subjects. While a subscription is active, buying individual subjects or bundles is turned off so you aren't charged twice. To buy subjects individually, cancel the subscription first.
- Internet requirement: Subscriptions require an internet connection to verify your status when the App launches. For fully offline use, buy subjects or bundles individually.
- Individual subjects and bundles: These are one-time purchases that unlock the content described in the App.
- Refunds: Refunds are handled only by Apple under its policies. Request one at reportaproblem.apple.com. We cannot issue refunds directly.
4. No affiliation
License to Sail is an independent study tool. It is not affiliated with, endorsed by, or sponsored by the U.S. Coast Guard (USCG), the National Maritime Center (NMC), or the U.S. Department of Homeland Security (DHS). References to these agencies are only for identification.
5. Educational use only — no guarantee
The App is a study aid. We do not guarantee that you will pass any USCG exam or obtain, renew, or upgrade any license, credential, rating, or endorsement. Exam content, eligibility, and credentialing decisions belong solely to the USCG and NMC. Your results depend on your own preparation and circumstances.
6. Content accuracy and checklists
Questions and illustrations come from publicly available USCG question banks and NMC sample exams, including historical materials. Answer explanations, question categories, and "most likely to appear" rankings (such as Study Pro) are our own interpretation or estimate, not official information. Questions, regulations, and requirements change, and the content may contain errors or be out of date.
The App's license checklists are for information only. They are derived from NMC checklists and Title 46 of the Code of Federal Regulations (46 CFR). They are summaries, they may not reflect the latest policy letters or rule changes, and they do not replace the NMC's evaluation of your application. Before relying on any content, check it against official sources, including the NMC and the eCFR. Use the in-app report button to tell us about errors.
7. AI explanations (Neptune AI)
Neptune AI explanations are generated by Apple Intelligence. AI output may be inaccurate, incomplete, or misleading. It is not official guidance and is not professional, legal, or navigational advice. Always verify it against official sources.
8. Not for operational use
The App is for exam study only. Do not use it for actual navigation, vessel operation, engineering work, safety decisions, or legal compliance.
9. Acceptable use
You agree not to:
- copy, scrape, extract, or redistribute the App's question bank, explanations, or other content;
- share, resell, or bypass purchases or subscriptions;
- interfere with, overload, or try to gain unauthorized access to the App, its servers, or its data;
- reverse engineer the App, except where the law allows it;
- submit false, abusive, or unlawful reports or messages; or
- use the App in violation of any law.
We may suspend or end your access if you break these Terms.
10. Intellectual property
The App's software, design, branding, organization of content, explanations, checklists, and other original material belong to us or our licensors and are protected by law. Underlying U.S. government works remain in the public domain. "License to Sail" and its logo are our marks. Apple, iCloud, and Apple Intelligence are trademarks of Apple Inc.
11. Disclaimer of warranties
THE APP, SITE, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST WAGES, LOST EMPLOYMENT OPPORTUNITIES, FAILED EXAMS, EXAM OR APPLICATION FEES, DELAYED OR DENIED CREDENTIALS, OR LOST DATA, ARISING FROM OR RELATED TO THE APP OR THESE TERMS. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50. These limits apply even if a remedy fails of its essential purpose.
13. Indemnity
You agree to defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or your violation of these Terms or of law.
14. Governing law and disputes
These Terms are governed by the laws of the state where Pearson Smith resides, without regard to conflict-of-law rules. Before filing any claim, you agree to email us at licensetosail@agentmail.to with a description of the issue and to try in good faith to resolve it informally for at least 30 days. Any claim not resolved this way must be brought in the state or federal courts in the county where Pearson Smith resides, and both parties consent to that jurisdiction, except that either party may bring an eligible claim in small-claims court. Nothing here limits consumer rights that cannot be waived under the law where you live.
15. Apple App Store terms
If you got the App from Apple's App Store, you and we acknowledge that:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
- Your license is limited to a non-transferable license to use the App on Apple-branded products you own or control, as allowed by the Usage Rules.
- Apple has no obligation to provide any maintenance or support for the App.
- If the App fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, or costs from a warranty failure are our responsibility, to the extent not disclaimed in these Terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
- If a third party claims the App or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- You must follow any applicable third-party terms (for example, your wireless data agreement) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Termination
You may stop using the App at any time. We may suspend or end your access for a violation of these Terms. Sections 4–7 and 10–17 survive termination.
17. General
Severability: If any part of these Terms is unenforceable, the rest stays in effect. No waiver: Not enforcing a term is not a waiver. Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us about the App. Assignment: We may assign these Terms, including to a business entity we form in the future; you may not assign them without our consent.
18. Changes
We may update these Terms. We will post the new version on this page and update the "Last updated" date. Continuing to use the App after changes take effect means you accept them. Changes to subscription prices follow Apple's notice and consent rules.
